These Terms & Conditions ("Agreement") govern the rental of motorcycles and scooters ("Motorcycle") provided by Nee's Motorbikes Rental Phuket ("Company"). By signing the Rental Agreement and/or accepting delivery of the Motorcycle, the renter ("Renter") agrees to be bound by these Terms & Conditions.

1. Eligibility

The Renter must:

• Be at least 18 years of age.
• Hold a valid passport.
• Hold a valid motorcycle driving licence.
• Hold a valid International Driving Permit (IDP) with motorcycle class A or A1 where required by Thai law.
• Present copies of the passport and driving licence before delivery.

The Company reserves the right to refuse any rental without providing a reason.

2. Reservations

Reservations may be made through:

• Website
• WhatsApp
• Telephone
• Email

No advance payment is required.

Reservations become confirmed only after written confirmation by the Company.

3. Delivery & Collection

Nee's Motorbikes Rental Phuket offers FREE delivery and collection anywhere on Phuket Island.

Motorcycles may be delivered to:

• Hotels
• Resorts
• Apartments
• Villas
• Private residences (where accessible)

4. Rental Agreement

Upon delivery both parties shall sign a Rental Agreement.

The Rental Agreement records:

• Customer information
• Motorcycle make and model
• Registration number
• Rental period
• Date and time of delivery
• Date and time of return
• Motorcycle condition
• Fuel level
• Accessories supplied
• Rental price
• Copies of identification documents
• Signatures of both parties

The Rental Agreement forms an integral part of these Terms & Conditions.

5. Payment

Payment is due upon delivery.

Accepted payment method:

• Cash in Thai Baht (THB) only.

No credit cards or digital payment methods are accepted unless otherwise agreed.

6. Security Deposit

No security deposit is required.

Instead, the Company requires:

• Copy of passport
• Copy of valid motorcycle licence

7. Motorcycle Condition

Every motorcycle is delivered:

• Fully serviced
• Professionally maintained
• Clean
• In excellent or like-new condition
• Fully insured
• With a full fuel tank
• Equipped with two helmets stored in the top box

The Renter confirms that the Motorcycle has been inspected and accepted in satisfactory condition upon delivery.

8. Fuel Policy

The Motorcycle is delivered with a full fuel tank.

The Motorcycle must be returned with a full tank.

If returned without a full tank, the Company may charge the cost of refuelling together with a reasonable refuelling service fee.

9. Insurance

All motorcycles are insured in accordance with Thai law.

Insurance coverage is subject to the terms and exclusions of the applicable insurance policy.

The Renter remains responsible for:

• Insurance deductibles
• Damage caused by negligence
• Damage excluded by the insurance policy
• Traffic fines
• Loss of accessories

Driving while intoxicated or under the influence of illegal substances may invalidate insurance coverage.

10. Permitted Use

The Motorcycle may only be:

• Operated by the named Renter.
• Used on public roads.
• Used within Phuket Island only.

The Motorcycle must not be transported by ferry or any other means to another island or province without prior written permission from the Company.

11. Prohibited Use

The Motorcycle shall not be used:

• For racing
• Off-road
• For commercial transport
• For illegal activities
• Under the influence of alcohol or drugs
• By unlicensed persons
• By any person not listed in the Rental Agreement

12. Renter Responsibilities

The Renter agrees to:

• Wear a helmet at all times.
• Ensure passengers also wear helmets.
• Properly secure the Motorcycle.
• Lock the steering whenever parked.
• Take reasonable care of the Motorcycle.
• Check engine oil and tyre pressure during long rentals.
• Immediately report accidents or mechanical problems.

13. Accidents

In the event of an accident the Renter shall:

• Stop immediately.
• Notify the Company without delay.
• Contact the Royal Thai Police where required.
• Cooperate fully with the insurance process.
• Not admit liability to third parties.

14. Breakdown

If a mechanical breakdown occurs that is not caused by misuse or negligence, the Company will provide reasonable assistance.

Repairs may not be carried out without prior authorization.

15. Traffic Violations

The Renter is solely responsible for:

• Parking fines
• Speeding tickets
• Toll violations
• Traffic offences
• Police penalties

16. Damage

The Renter is responsible for damage caused through:

• Negligence
• Misuse
• Careless operation
• Violation of these Terms

Normal wear and tear is excluded.

17. Late Return

The Motorcycle must be returned at the agreed date and time.

Late returns may be charged at the applicable daily rental rate unless otherwise agreed.

18. Theft or Failure to Return

Failure to return the Motorcycle on the agreed date without prior authorization constitutes unlawful possession of Company property.

If the Motorcycle is not returned, or the Company cannot establish contact with the Renter, the Company reserves the right to immediately report the matter to the Royal Thai Police as suspected theft or unlawful appropriation.

The Company further reserves the right to initiate civil and criminal proceedings and to recover all resulting losses, damages, legal costs and expenses.

19. Personal Property

The Company accepts no responsibility for personal belongings left inside the Motorcycle or top box.

20. Cancellation

As no advance payment is required, reservations may be cancelled free of charge before delivery.

21. Limitation of Liability

The Company shall not be liable for:

• Personal injury
• Loss of income
• Missed flights
• Missed hotel reservations
• Weather conditions
• Road conditions
• Events beyond the Company's control

Liability shall be limited to the amount of the rental fee paid.

22. Privacy

Personal information is processed in accordance with the Company's Privacy Policy and the Thai Personal Data Protection Act (PDPA).

23. Force Majeure

The Company shall not be liable for delays or failure to perform caused by circumstances beyond its reasonable control, including but not limited to natural disasters, floods, government actions, pandemics, strikes or transportation disruptions.

24. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

25. Governing Law

These Terms & Conditions shall be governed by the laws of the Kingdom of Thailand.

Any dispute arising from this Agreement shall be subject to the exclusive jurisdiction of the competent courts in Phuket, Thailand.
